By using the Website or making purchases on the Website you agree to be bound by these Terms of Use. The Wedding Series reserves the right to change these Terms of Use by giving 7 days notice on the Website and by using the Website you agree to be bound by such changes. If you do not agree with the Terms of Use or as amended from time to time please do not use the Website.

  • 1.3 You warrant and represent that you have the legal right and ability to enter into legally binding agreements with The Wedding Series.

  • 3.3 Certain material which appears on the Website such as photographs and images may be sourced from third parties and in such cases, The Wedding Series has recognised the source of those materials.

  • 3.4 The brand The Wedding Series and The Love Story Series and all design marks and slogans are the trade marks or service marks of The Wedding Series Pty Ltd.

  • 4.1 You are granted a non-exclusive, non-assignable and non-transferable licence to use this Website only under these Terms of Use.

  • 4.2 You may use the Website and view and access the Material only for your personal and non-commercial use. Nothing in these Terms of Use or the Website will be construed as granting to you ownership of the Material or any proprietary right to the copyright, trade marks, patents or other intellectual property rights of The Wedding Series, its related bodies corporate or any third party.

  • 4.3 You may not sell, modify, copy, distribute, transmit, display, perform, reproduce, republish, licence, frame, upload, transmit, post, communicate or use the Materials except:

    • re-posting an image or story citing theweddingseries.com as the source;

    • as expressly authorised either in the Website or these Terms of Use; or

5 - Your responsibilities

  • 9.4 Without limitation to any other provision in these Terms of Use, The Wedding Series acknowledges that the Competition and Consumer Act 2010 (Cth) (Act) and other statutes from time to time enforced in Australia may imply warranties or conditions or impose guarantees or obligations upon The Wedding Series in relation to products and services available on the Website which cannot be excluded, restricted or modified except to a limited extent. If any such statutory provisions apply, then to the extent to which The Wedding Series is entitled to limit its liability under that statutory provision (including, pursuant to Schedule 2, Sections 64A and 276A of the Act), The Wedding Seriess’s liability shall be limited to any one or more of the following in its sole discretion: (i) in the case of any product, the replacement or repair of the product, or the supply of equivalent products, or the payment of the cost of replacing or repairing the products or acquiring equivalent products; (ii) in the case of any service, the supply of the services again, or the payment of the cost of having the services supplied again.

10 - Indemnity and Release

  • 10.1 You indemnify and release The Wedding Series Pty Ltd from and against all claims, actions, liabilities, costs and expenses (including legal costs on a full indemnity basis) resulting from (a) your use of the Website; (b) your failure to comply with these Terms of Use; and (c) any activity relating to Your Account.

11 - Termination

  • 11.1 The Wedding Series may, in its sole discretion and without prior notice to you, terminate your licence to access to the Website and the Materials if you breach these Terms of Use.

12 - Applicable law

  • 12.1 The Website is controlled by The Wedding Series from its offices in Queensland and New South Wales, Australia. The Wedding Series makes no representation that the Material or the Website is appropriate or available for use in other locations. Those who choose to access the Website from locations outside of Australia do so at their own initiative and are responsible for compliance with local laws.

  • 12.2 These terms will be governed by and construed in accordance with the laws of New South Wales, Australia and you irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of New South Wales, Australia.

  • 13.1 These Terms of Use represent the entire binding agreement between you and The Wedding Series, and our respective successors and assigns, and supersede any and all prior understanding, statements or representations, whether electronic, oral or written, regarding The Wedding Series, the Website, or the information and contents on the Website.

  • 13.2 No waiver of any obligation or right by The Wedding Series will be effective unless in writing and executed by The Wedding Series.

  • 13.3 If any provision in these Terms of Use is found to be invalid or unenforceable by a court of New South Wales, such invalidity or unenforceability will not affect the reminder of these terms and conditions which will continue in full force and effect.
